1. Our approach
We respect intellectual property rights and expect our users to do the same. Users may upload only content they own or are licensed to use. Stock footage included by Bespoke is licensed from our stock providers for use inside finished videos only.
2. Reporting infringement
If you believe content processed or stored by Bespoke infringes your copyright or other intellectual property, send a notice to grievance@thewictory.net with the subject "Copyright notice", including:
- your name, address, phone number and email;
- a description of the work you believe is infringed;
- the location of the infringing material (for example the shared link or account details), with enough detail for us to find it;
- a statement that you believe in good faith that the use is not authorised by the owner, its agent or the law;
- a statement that the information in your notice is accurate and that you are the owner or authorised to act for the owner;
- your physical or electronic signature.
We handle notices in accordance with the Information Technology Act, 2000 and its intermediary rules, the Copyright Act, 1957 and, where applicable, the US Digital Millennium Copyright Act (DMCA).
3. What we do
When we receive a valid notice, we act expeditiously to remove or disable access to the material, and where appropriate inform the user concerned. We keep a record of the notice.
4. Counter-notice
If your content was removed and you believe this was a mistake or that you have the right to use it, you can send a counter-notice to the same address with your contact details, identification of the removed material, a statement under penalty of perjury that you believe it was removed by mistake, and your consent to the jurisdiction of the courts at SAS Nagar (Mohali), Punjab. We may restore the content unless the complainant tells us they have started legal action.
5. Repeat infringers
We close the accounts of users who repeatedly infringe the rights of others.
6. Our intellectual property
Bespoke, its software, design, caption styles, templates, name and logo are the intellectual property of THE WICTORY or its licensors. You may not copy or use them without our written permission, except to refer to our product in a fair and accurate way.
