Terms of Service

These Terms of Service ("Terms") govern your access to and use of Bespoke, the AI video editing service available at thewictory.net (the "Service"). The Service is provided by THE WICTORY, based in Mohali, Punjab, India ("The Wictory", "we", "us" or "our").

By creating an account, purchasing a plan or otherwise using the Service, you agree to these Terms, our Privacy Policy and the policies linked from them. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms for that organisation, and "you" includes that organisation. If you do not agree, do not use the Service.

1. The Service

Bespoke edits short talking-head videos automatically. You upload a video and its script, choose your options, and the Service produces a finished portrait (9:16) video. Depending on the options you choose, processing may include caption generation and timing, B-roll selection from licensed stock footage, zoom effects, presenter and brand cards, a call-to-action segment, pause trimming, voice clean-up and picture enhancement.

The Service relies on automated systems, including artificial-intelligence models. Results depend on the quality of your footage, audio and script, and may vary. You are responsible for reviewing every video before you publish it. See our AI-Generated Content Disclosure.

We may improve, change or discontinue features of the Service from time to time. Where a change materially reduces what a paid plan includes, we will tell you in advance by email or in the Service.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You must give accurate information when you register and keep it up to date.

You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately at support@thewictory.net if you suspect unauthorised use. Each account is for one person or organisation; you may not sell, transfer or share access to your account except as a plan expressly allows.

3. Free trial

New accounts can receive a one-time free trial of 60 Quick Mode credits (2 Quick Mode videos) after verifying an Indian mobile number by one-time password. The trial is limited to one per person: one per mobile number, per account, and per device, browser, email address or network. To apply this rule we check the mobile number, a device identifier, a browser fingerprint, the email address and the network (IP address) used at sign-up (see our Privacy Policy). Videos created with free trial credits may include a small Bespoke watermark; videos created on a paid plan do not. We may withdraw the trial from accounts that abuse it, including through multiple accounts or numbers.

4. Plans, credits and payment

Paid plans are monthly or yearly subscriptions sold in Indian Rupees (INR), paid in advance through our RBI-authorised payment gateway partner, and, once automatic renewal is switched on, renewed automatically until you turn it off; until then each plan is a one-time payment (see the Subscription & Billing Policy). Prices already include a flat discount on every plan, so coupon and promo codes are not accepted. The free trial and Quick Mode plans do not include Expert Mode; Expert Mode accounts do not receive the free trial and do not use Quick Mode. Current plans:

• Quick Mode: one video uses 30 credits for input videos from 10 seconds to 2 minutes.
• Expert Mode: a video uses 30 Expert credits for every started 3 minutes (up to 3 min = 30, up to 6 min = 60, up to 9 min = 90, up to 10 min = 120). Expert videos can be up to 10 minutes; for longer videos contact support.
• Quick Mode credits and Expert Mode credits are separate and can only be used in their own mode.
• Credits are reserved when a video starts and returned automatically if it fails.
• Plan credits are added every month — with each monthly payment, or automatically each month during a yearly plan — and are valid for one month. Unused credits expire at the end of that month and do not carry over.
• Credits are for use in the Service only. They have no cash value and cannot be transferred, sold or exchanged.

You can turn off auto-renew from your plan screen; you are not charged again and paid credits stay until they expire. Unstarted months of a yearly plan are refundable as set out in the Refund Policy. We may change prices for future periods; we tell you before a change applies to your subscription.

5. Your content

"Your Content" means the videos, audio, scripts, images, logos, photographs and other material you upload, and the instructions you give. You keep all ownership rights in Your Content.

You grant The Wictory a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and modify Your Content only as needed to provide, secure and support the Service for you, including sending it to the service providers listed in our Third-Party Services Disclosure. This licence ends when Your Content is deleted from our systems under our Data Retention & Deletion Policy. We do not use Your Content to advertise our Service or publish it anywhere without your separate written permission.

You confirm that you own Your Content or have all rights, licences and consents needed to upload it and to have it processed, including the consent of every person who appears or is heard in it. See our User-Uploaded Content Policy.

You are solely responsible for your content. You alone are fully responsible for all content you upload, create, edit, download, share or publish using the Service, including its legality, accuracy, and every claim, right and consent relating to it. The Wictory provides an automated technical service and acts as an intermediary under the Information Technology Act, 2000: we do not author, select, review, approve or endorse user content, and we are not responsible or liable for it. If you upload or create content that is unlawful, sexually explicit, obscene, defamatory, infringing, misleading or otherwise prohibited, you alone bear all legal responsibility and consequences, and you will indemnify The Wictory as set out in section 15. We may remove such content and report it to the authorities where the law requires.

6. Output videos and stock footage

Subject to these Terms, you own the finished videos the Service produces for you ("Output"), excluding third-party material included in them. Output may include licensed stock footage chosen by the Service. That footage is licensed to you only as part of the Output, as a secondary element of your video. You may not extract, separate, resell or redistribute any stock clip on its own. Details are in our Stock Footage Licensing Information.

7. Acceptable use

You must use the Service lawfully and in line with our Acceptable Use Policy. We may refuse to process, remove or disable content, and suspend or close accounts, that break these Terms or the law, or that put the Service or others at risk.

8. Health, financial and professional content

Bespoke is an editing tool. It does not create, check or approve the claims made in your videos. If you publish medical, health, legal, financial or other professional information, you are solely responsible for its accuracy and for complying with the rules that apply to your profession, including advertising and patient-privacy rules. 9. Intellectual property in the Service

The Service, including its software, design, caption styles, templates, the Bespoke name and logo, and all related intellectual property, belongs to The Wictory or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for your own videos while your account is in good standing. You may not copy, reverse engineer, resell, or build a competing service from the Service, or access it by automated means except as we allow.

10. Feedback

If you send us suggestions or feedback, you allow us to use them to improve the Service without any obligation to you.

11. Suspension and termination

You may stop using the Service and ask us to delete your account at any time; see our Account Deletion Policy. We may suspend or terminate your access, with notice where reasonably possible, if you breach these Terms, if required by law, or if your use creates a risk for the Service or others. On termination, your right to use the Service ends, and unused credits lapse, except where a refund is due under our Refund Policy.

12. Availability

We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free or available at any particular time. Processing times shown in the Service are estimates. Planned maintenance and events outside our reasonable control (such as failures of networks, hosting or third-party services) may affect the Service.

13. Disclaimer of warranties

To the extent permitted by law, the Service and Output are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Nothing in these Terms limits rights you have under consumer-protection law that cannot be excluded.

14. Limitation of liability

To the extent permitted by law, The Wictory will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to the Service. Our total liability for all claims relating to the Service in any 12-month period is limited to the amount you paid us for the Service in that period. These limits do not apply to liability that cannot be limited by law, such as liability for fraud.

15. Indemnity

You will indemnify and hold harmless The Wictory and its staff from claims, losses and expenses (including reasonable legal fees) arising from Your Content, your use of Output, or your breach of these Terms or the law.

16. Governing law and disputes

These Terms are governed by the laws of India. Before starting any legal proceedings, please contact our Grievance Officer so that we can try to resolve the matter. Subject to that, the courts at SAS Nagar (Mohali), Punjab, India have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

17. Changes to these Terms

We may update these Terms. We will post the new version on this page with a new effective date and, for material changes, notify you by email or in the Service at least 7 days before they take effect. If you continue to use the Service after a change takes effect, you accept the updated Terms.

18. General

These Terms, together with the policies they link to, are the entire agreement between you and The Wictory about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them to a successor of our business.
